Rules posted here have been adopted and are in effect as noted, but have not yet been certified.  Once certified, they will be posted on the OLS website at the link listed above under “Rules”.  Until they are certified, the adopted rules are the official version of the rules in effect.  For Rulemakings that amend only a portion of a set of existing rules, the amendments posted here must be read in conjunction with the remaining rules.

Plc 700  Electrologists

Public Hearing:  Wednesday, February 23, 2022 at 1:30 PM in the Hearing Room at the OPLC offices at 7 Eagle Square, Concord NH
**You do not need to attend the hearing to submit written comments.**

Deadline for Submitting Written Comment:  4:00 PM on Friday, March 4, 2022

The deadline for submitting written comments has been extended to Friday, April 15, 2022
Please submit comments to OPLC-Rules@oplc.nh.gov.

A Final Proposal has been filed for review by the Joint Legislative Committee on Administrative Rules (JLCAR), anticipated to occur at the meeting scheduled for Thursday, September 15, 2022.

The OPLC has filed the following response to the preliminary objection entered by the JLCAR, and anticipates that the response will be considered at the JLCAR meeting scheduled for October 20, 2022:

Plc 1001.07 Application Fee for Temporary Permits

Public Hearing:  Thursday, November 10, 2022 at 2:30 PM in the Board Room at the OPLC offices at 7 Eagle Square, Concord NH

Plc 1400  Recreational Therapists  INTERIM

OPLC is proposing to adopt Plc 1400 as INTERIM rules to regulate the practice of Recreational Therapy.  If adopted, the rules will be in effect for 180 days or until regular (10-year) rules are adopted, whichever is sooner.  

The rules are expected to be on the agenda for JLCAR review at the meeting scheduled for December 15, 2022.  A  public hearing will be held when the rules are proposed as regular rules, but no public hearing will be held on the Proposed Interim Rules.  However, you may submit comments to OPLC-Rules@oplc.nh.gov on the Proposed Interim Rules; any comments received will be considered prior to establishing the Initial Proposal for regular rules.

Plc 1500  Respiratory Care Practitioners  INTERIM

OPLC is proposing to adopt Plc 1500 as INTERIM rules to regulate the practice of Respiratory Care.  If adopted, the rules will be in effect for 180 days or until regular (10-year) rules are adopted, whichever is sooner.  

The rules are expected to be on the agenda for JLCAR review at the meeting scheduled for November 17, 2022.  A  public hearing will be held when the rules are proposed as regular rules, but no public hearing will be held on the Proposed Interim Rules.  However, you may submit comments to OPLC-Rules@oplc.nh.gov on the Proposed Interim Rules; any comments received will be considered prior to establishing the Initial Proposal for regular rules.    

The OPLC has filed a request for the JLCAR to enter a conditional approval in order to address OLS comments and make additional changes.  The changes are explained below:
